TITANSEAT – DISTANCE SALES AGREEMENT

The person who makes an online purchase from www.titanseat.com.tr.
2. SUBJECT
This agreement governs the seller’s rights and obligations regarding the characteristics, sales price, and delivery of products/services sold through the seller’s website, in accordance with the provisions of Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
3. PRODUCT AND PAYMENT INFORMATION SUBJECT TO THE CONTRACT
The product type, quantity, sales price, payment method, and delivery address are as specified in the system at the time the order is placed; the invoice recipient and delivery information are as stated on the order form.
4. DELIVERY CONDITIONS
The product will be shipped to the address specified by the buyer at the time of ordering within the legal 3 business days. The seller is not responsible for delays caused by force majeure or carrier-related delays.
5. RIGHT OF WITHDRAWAL
The buyer may exercise their right of withdrawal within 14 days of receiving the product without providing any reason or penalty. To exercise the right of withdrawal, the product must be unused and in resalable condition.
Return Terms:
• The product must be returned with its original packaging and all accessories.
• Shipping costs are the responsibility of the consumer; however, for defective products, these costs are the responsibility of the seller.
• The notice of withdrawal must be made in writing or via permanent data storage (email, WhatsApp, etc.).
6. CASES WHERE THE RIGHT OF WITHDRAWAL IS INVALID
• Products manufactured according to the buyer’s specific requests,
• Assembled or custom-made products,
• In cases where the installed product cannot be resold after disassembly.
7. PRODUCT DEFECTS AND WARRANTY
The product is covered by a 2-year warranty under Law No. 6502. In the event of a defective product, the buyer may request a refund, replacement, or free repair. Notification must be made within the first 30 days of receiving the product.
8. DISPUTE RESOLUTION
In cases of dispute, the Provincial/District Consumer Arbitration Committees or Consumer Courts in the buyer’s residence have jurisdiction. The application limit is determined by the monetary limits announced annually by the Ministry of Trade.
9. ENFORCEMENT
This agreement enters into force upon electronic confirmation by the buyer. Placing an order constitutes acceptance of the terms of the agreement.

10. GENERAL PROVISIONS
10.1. The buyer acknowledges, declares, and undertakes to have read and understood all preliminary information regarding the product subject to the agreement, including its basic characteristics, sales price, payment method, delivery conditions, and right of withdrawal, and to have provided the necessary confirmation electronically.
10.2. The seller is obligated to deliver the ordered product or service in full, in accordance with the specifications specified in the order, and accompanied by any warranty documents and user manuals.
10.3. Product delivery will be made to the address and person specified by the buyer. If the buyer is not present at the specified address at the time of delivery, the seller cannot be held responsible for any delivery delays.
10.4. The seller assumes no liability for any damage to the product caused by the buyer or a third party after delivery.
10.5. The buyer has the right of withdrawal for the product/service ordered within the legally stipulated time and conditions. However, this right does not apply to personalized or installed products.
10.6. In the event of any dispute, the seller’s commercial records and digital system records (order data, invoice information, email correspondence, cargo delivery documents, etc.) will be used as evidence and will be considered definitive evidence.
10.7. If the seller is unable to fulfill the order due to force majeure (natural disaster, war, strike, transportation obstacles, epidemics, government decisions, etc.), the seller may cancel, postpone, or provide an equivalent product by notifying the buyer.
10.8. The provisions of this contract are subject to the laws of the Republic of Turkey. Istanbul Anatolian Courthouse Courts and Enforcement Offices have jurisdiction over any disputes arising from the contract.
